1. Application
These terms govern purchases from Spirits Reserve and use of our online store.
References to “we,” “us,” and “our” mean Wyonna Keontay Heard doing business as Spirits Reserve.
Shopify provides the e-commerce platform. The seller under your purchase contract is Wyonna Keontay Heard, an individual based in Georgia, United States.
The store accepts orders for delivery within Australia only. Store prices and payments are in Australian dollars, AUD.
2. Eligibility and accurate information
You must have the legal capacity to enter into a purchase contract or act with appropriate authorization.
Provide accurate contact, billing, and delivery information. You must be authorized to use the payment method selected at checkout.
Notify us promptly if information relating to an order needs correction.
3. Products and descriptions
Spirits Reserve sells drinkware and related accessories, including drinking glasses and reusable cooling stones. The store does not sell alcoholic beverages.
The applicable product listing describes the item offered for purchase. Images may display colors differently depending on your screen, but this does not limit your right to receive goods that match their description.
Follow the product’s supplied care and use instructions. Do not continue using an item that is damaged or appears unsafe.
4. Prices and payment
Prices and checkout payments are in AUD.
Applicable shipping charges and taxes collected by the store are disclosed before you complete checkout.
Customs or import charges that may be payable separately are addressed in our Shipping policy.
Your financial institution may apply charges under its own agreement with you. These are separate from amounts charged by Spirits Reserve.
Payment is processed through the methods made available at checkout.
5. Orders and availability
After checkout, we send an order acknowledgment. We may contact you if an item is unavailable or if information is required to process your order.
If we identify a material pricing or description error, we will explain the issue and seek your agreement before proceeding on changed terms.
If you do not agree to the change, or we cannot fulfill the order, we will cancel the affected purchase and refund any payment received for it.
We may decline or cancel an order where reasonably necessary because of suspected fraud, an unauthorized payment, legal restrictions, or an inability to supply the goods. Any payment taken for goods we will not supply will be refunded.
6. Fulfillment and shipping
Products are dispatched directly from China by a third-party supplier.
Processing takes approximately 2 to 3 days. Shipping generally takes 7 to 15 days after dispatch. These estimates are expressed in days, and processing occurs before the shipping period.
If we cannot dispatch within the stated period, we will provide notice and explain the available options concerning delay, cancellation, and refund.
Orders may arrive in separate packages. Further details appear in our Shipping policy.
We remain your contact for fulfillment problems. Using a supplier or carrier does not remove our responsibilities to you.
7. Cancellations and refunds
Cancellation and refund requests should be sent to support@spiritsreserveco.com.
Our Return and refund policy provides a 30-day dissatisfaction request period measured from delivery. Approved refunds do not require physical return of the product.
The voluntary policy operates alongside your statutory rights. Its deadline and exclusions do not restrict remedies available under applicable consumer law.
8. Australian consumer protections
Australian consumer protections apply to purchases directed to Australian customers, including purchases from overseas sellers.
Nothing in these terms excludes, restricts, or modifies a consumer guarantee, remedy, or other right that cannot lawfully be excluded. These terms do not limit liability where doing so would be unlawful.
9. Acceptable use of the website
You must not use the website to commit fraud, misuse another person’s information, introduce malicious software, interfere with security, or infringe intellectual property rights.
We may restrict access where reasonably necessary to address such conduct. An access restriction does not remove existing refund rights or other legal remedies.
10. Website content and external services
Website text, branding, images, and other content may be protected by intellectual property rights.
You may use the website for legitimate browsing and purchasing. Other uses require permission unless permitted by law.
The website may link to external services, including tracking and payment services. Their separate terms may govern your use of those services. Those terms do not replace our obligations as the seller.
11. Personal information and communications
We handle personal information as described in our Privacy policy.
The website provides a cookie banner allowing you to accept, reject, or customize optional cookies.
We may send communications necessary to administer your order, including payment, shipment, refund, and safety information. Marketing consent is handled separately where required.
12. Complaints
Contact support@spiritsreserveco.com with your order reference and a description of the issue.
We will assess the complaint and communicate the proposed resolution.
This process does not prevent you from contacting a consumer protection authority, payment provider, court, or tribunal with jurisdiction.
13. Governing law and jurisdiction
These terms are governed by the laws of the State of Georgia and applicable federal laws of the United States, subject to mandatory laws that protect Australian consumers.
Competent state and federal courts located in Atlanta or Fulton County, Georgia, have nonexclusive jurisdiction.
This provision does not require an Australian consumer to give up access to an Australian court or tribunal, or any mandatory right concerning jurisdiction, consumer protection, or remedies.
14. Changes and severability
We may update these terms for future purchases. The version applicable when you placed your order continues to govern that purchase unless a change is required by law or agreed with you.
If a provision is found unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions continue to apply, subject to mandatory law.
